Stakeholder Advisory
Restructurings and turnarounds are often driven by embedded equity interests in Canada, leaving stakeholders other than secured creditors sidelined. In the US, stakeholders have a more significant right of participation but need the advice to maximize recoveries.
We provide impartial advice and support to maximize recoveries for stakeholders. We act for secured creditors, unsecured creditors (including bond and debt holders, as well as trade creditors), government stakeholders and large equity holders.
Services Include:

Review of the viability of proposed turnaround and restructuring plans put forward by management, providing stakeholders with an unbiased view and risk analysis of compromise proposals, business plans, potential recoveries and strength/weaknesses of management teams

Developing recovery strategies and negotiating on behalf of stakeholders to maximize recoveries. Includes preparation of alternative restructuring and turnaround proposals if required.

Provide stakeholders with effective oversight of management teams, including a review of financial projections, cash conservation, and business plan development.

Lead negotiations on behalf of stakeholders

Provide post-restructuring performance monitoring and reporting.
